Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the PC Driver Booster website, PC Driver Booster desktop software, and related services.

The Services are operated by JKM Global Services LLP, DBA PC Driver Booster, located at G-45, First Floor, Sector-6, Noida, Uttar Pradesh, India.

These Terms incorporate our Privacy Policy and Cookie Policy.

Definitions

Eligibility & Account Registration

Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services.

Account Registration

• Provide accurate and complete information.
• Maintain and update your Account information.
• Keep your login credentials confidential.
• Do not share your Account with another person.
• Notify us of unauthorized Account use.

You are responsible for activity occurring under your Account.

Software License

Subject to compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to install and use the Software on a single computer per License Key.

License Types

License Restrictions

• Reverse engineer or decompile the Software.
• Modify or create derivative works.
• Rent, lease, sell or sublicense the Software.
• Remove proprietary notices.
• Use the Software unlawfully.
• Use the Software on unauthorized devices.
• Circumvent license enforcement mechanisms.

Activation & Updates

The Software requires activation through a License Key and may periodically validate that key.

The Software may automatically check for and install updates, including security patches and version upgrades.

Subscription, Billing & Auto-Renewal

Subscription Plans

Subscription plans, fees and billing intervals are displayed at the point of purchase.

One-Time Purchases

One-time perpetual license purchases are charged once and do not automatically renew.

Pricing Changes

Subscription fees may change for future Subscription Periods with advance notice.

Cancellation

You may request cancellation through your Account or by contacting support at support@pcdriverbooster.com .

Non-Payment

If payment fails repeatedly, access to the Services may be suspended or terminated.

Free Trial Terms

Payment Processing

Payments are processed securely by third-party payment processors including Stripe, Authorize.net, CyberSource, CyoGate, Revolut and PayPal.

We do not store or directly access your full payment card details.

Unless otherwise stated, fees are in US Dollars (USD).

User Conduct

You agree not to use the Services to:

• Violate applicable laws or third-party rights.
• Transmit viruses, malware or harmful code.
• Disrupt the Services.
• Attempt unauthorized access.
• Use unauthorized bots, scrapers or crawlers.
• Impersonate another person or entity.
• Damage or impair the Services.
• Conduct unauthorized competitive analysis.
• Send spam or unsolicited communications.

User Content & Feedback

User Content

If you submit reviews, comments, questions or other User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual and irrevocable license to use that content in connection with the Services.

You represent that you own or have the necessary rights to the content you submit.

Consumer Review Fairness Act

Nothing in these Terms prohibits or restricts lawful consumer reviews protected by applicable law.

Unsolicited Submissions

We do not accept unsolicited ideas or materials.

Privacy & Data Protection

Your use of the Services is also governed by our Privacy Policy and Cookie Policy.

Intellectual Property

Ownership

The Services, including content, features, software code, designs, trademarks, service marks, patents and know-how, are owned by the Company or its licensors.

Trademarks

"PC Driver Booster" is a registered trademark of JKM Global Services LLP. Other trademarks belong to their respective owners.

Reservation of Rights

All rights not expressly granted under these Terms are reserved by the Company.

DMCA Copyright Claims

If you believe material available through the Services infringes your copyright, you may submit a DMCA notification to:

Termination

Termination by You

You may terminate your Account and stop using the Services at any time by contacting support.

Termination by Us

We may suspend or terminate access immediately if you breach these Terms or otherwise violate applicable requirements.

Effect of Termination

• Your right to use the Services ceases.
• License Keys may be deactivated.
• Account data may be deleted according to the Privacy Policy.
• Certain provisions survive termination.

Governing Law

These Terms and disputes arising from them are governed by the laws of the State of California, United States, without regard to conflict of laws principles.

Dispute Resolution & Binding Arbitration

Informal Resolution

Before initiating formal proceedings, you agree to first contact the Company and allow at least 30 days for informal resolution.

Binding Arbitration

Disputes shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

Class Action Waiver

Each party agrees to bring claims only in its individual capacity and not as a plaintiff or class member in a class proceeding.

Small Claims Exception

Qualifying claims may be brought in small claims court in Upland, California, on an individual basis.

CCPA / CPRA Notice

California residents may have rights under the California Consumer Privacy Act and California Privacy Rights Act.

Additional provisions apply to users located in the European Economic Area and United Kingdom.
